Terms of Service & Disclaimer

These Terms of Service ("Terms") govern your use of DNSBenchmarkPro.com and the DNS Benchmark Pro tool (the "Service"), operated by Genext Information Systems ("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DNS Benchmark Pro is a free, browser-based tool that measures the response time of public DNS resolvers using DNS-over-HTTPS and presents recommendations. The Service is provided for informational purposes only.

2. No Affiliation

We are an independent service. We are not affiliated with, sponsored by, or endorsed by any DNS provider referenced in the Service (including Cloudflare, Google, Quad9, OpenDNS/Cisco, AdGuard, Mullvad, or Control D). All trademarks and IP addresses belong to their respective owners and are used for identification only.

3. Acceptable Use

You agree not to:

Use the Service in violation of any applicable law or regulation.
Attempt to disrupt, overload, scrape at scale, reverse engineer, or gain unauthorized access to the Service or its infrastructure.
Use automated means to run the benchmark in a way that abuses third-party DNS or geolocation providers.
Remove, obscure, or interfere with advertising or legal notices.

4. DNS Changes Are at Your Own Risk

The Service may suggest changing your device or network DNS settings. You are solely responsible for any configuration changes you make. Incorrect DNS settings can affect your internet connectivity. We recommend noting your current settings before changing them, and consulting a qualified professional if you are unsure.

5. Disclaimer of Warranties

The Service and all results, scores, and recommendations are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that results will be accurate, complete, reliable, current, or error-free, or that the Service will be uninterrupted or secure. Browser-based tests provide guidance only and are not identical to native system ping tests; actual performance varies by network, time, device, and configuration.

6. Limitation of Liability

To the maximum extent permitted by law, Genext Information Systems and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, connectivity, profits, or goodwill, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the Service shall not exceed USD $100 or the amount you paid us for the Service (which is zero), whichever is greater.

7. Third-Party Links and Services

The Service relies on and links to third-party services (advertising, geolocation, and public DNS resolvers). We are not responsible for the content, policies, or practices of those third parties. Your use of them is governed by their own terms and privacy policies.

8. Advertising

The Service is supported by advertising, including Google AdSense. By using the Service you acknowledge that ads may be displayed. Advertising practices and your choices are described in our Privacy Policy and Cookie Policy.

9. Intellectual Property

The Service's design, code, text, and branding (excluding third-party trademarks) are owned by Genext Information Systems and protected by applicable laws. You may not copy, reproduce, or create derivative works without our prior written permission.

10. Indemnification

You agree to indemnify and hold harmless Genext Information Systems from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.

11. Changes to the Service or Terms

We may modify or discontinue the Service, and may update these Terms, at any time. Material changes are reflected by the "Last updated" date. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which the operator is established, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any disputes, to the extent permitted by law.
